Terms And Conditions

Mojo Divers Ltd Pty (hereinafter Mojo Divers) agree to make every possible effort to ensure that your diving experience will be safe and enjoyable; will meet or exceed all the required diving industry standards, comply with local customs and government laws and regulations, environmental best practice and guidelines.

Customers who sign up for diving and diving related activities agree to the following terms and conditions:

I agree to pay Mojo Divers for all diving related activities in full that I book for as listed on the website, on brochures, posters or prices agreed with their authorized agents.  A deposit is required on signing up for diving and the balance is due before any in-water activities.  If booking in advance via the website a deposit is required with the balance due on arrival.

No refund will be given if the customer fails to show or cancels with less than 24 hours notice.

I understand that diving certifications are not guaranteed and that if I fail to meet the required standards at any time during the course(s) no certification will be issued and no refund will be given.  However, Mojo Divers will make every effort to provide additional training if this required and only in exceptional circumstances will additional costs apply.

I understand that Mojo Divers may alter the accommodation advertised as this subject to availability at its’ partnership resorts and that additional costs may be payable for upgraded accommodation.  Should I require additional accommodation beyond that provided by Mojo Divers I will contact and pay direct to the resort where I wish to stay.

I understand that Mojo Divers may at any time change agreed diving locations due to unforeseen circumstances, weather conditions or inappropriate conduct or cancel the diving due to adverse or unsafe conditions.  If necessary Mojo Divers will reschedule your diving to ensure that course standards are met.

I agree to compensate at full market value Mojo Divers or its partners for the loss or damage of any equipment, materials or property as a result of negligence or abuse.

If I fail to show up for diving no refund will be given.  If I fail to show during a course and I wish to continue my diving on another day, subject to availability, then an additional fee of 1500 baht is payable. If I wish to cancel after starting course, I may receive a partial refund at the discretion of the manager, less any course fees and staff fees.

I understand that Mojo Divers, its staff and partners may at any time cancel my diving at their discretion due to a breach of dive industry standards, inappropriate or unsafe conduct or a lack of respect for ecological best practice and guidelines and no refund will be given.

I hereby affirm that I am a certified diver or a student diver under the control and supervision of a certified dive professional, and that I fully understand the hazards of diving and diving related activities including those hazards occurring during boat travel to/from the dive sites.

I understand that these hazards include, but are not limited to, air expansion injuries, drowning, decompression sickness, slipping or falling on the boat, being cut or struck by a boat in the water, injuries occurring while getting on/off the boat and other perils at sea.

I certify that I am fully aware of and expressly assume these and other risks involved in making such a dive or dives, whether conducted as a recreational dive or as part of a diving course.

I understand and agree that neither Mojo Divers, the boat crew, staff, the owner of the vessel(s), nor any boats owned or operated by Mojo Divers, its partners, nor SSI, nor its affiliates (hereinafter “release parties”) may be held liable or responsible in any way for any occurrence on all dive trips I undertake with Mojo Divers.  Which may result in personal injury, property damage, wrongful death or other damage to me or my family, heirs, or assigns that may occur as a result of my participation in all boat trips I undertake with Mojo Divers and diving or snorkel activities or as a result of the negligence of any party, including the release parties, whether passive or active.

I further state that I am of lawful age and legally competent to sign liability releases and medical statements or that I have obtained written consent from my parent or guardian.
